Solar System Batteries Australia Pty Ltd (trading as SolarSystemBatteries.com.au)

1. Introduction

1.1 Parties to this Agreement 

This Agreement is entered into between: 

  • Solar System Batteries Australia Pty Ltd ABN 40 644 925 655 (“Solar System Batteries Australia Pty Ltdr”, “we”, “our”, or “us”); and
  • The customer identified in the Quote (“you” or “your”). 

1.2 Agreement Documents 

This Agreement consists of:

  • These Terms and Conditions; and
  • The Quote, including the Full System Design and any attachments. 

1.3 Scope of Agreement 

This Agreement governs: 

  • Your purchase of the solar photovoltaic system and associated equipment (“System”); and
  • Delivery, installation, commissioning, and related services at the Premises. 

1.4 Commencement of Agreement 

This Agreement commences when you accept the Quote by: 

  • Signing and returning the Quote by post, email, or electronically; 
  • Paying the Deposit; or 
  • Providing verbal confirmation to proceed. 

Where verbal acceptance is provided, Solar System Batteries Australia Pty Ltdr will issue a copy of this Agreement within seven (7) days. 

1.5 Conditions Precedent 

Your purchase is conditional upon: 

  • Payment of the Deposit; and 
  • Approval from the relevant electricity distributor for Grid Connection Approval. 

1.6 Completion of Agreement 

This Agreement concludes upon completion of installation and commissioning of the System, unless terminated earlier in accordance with these Terms. 

1.7 Continuing Obligations 

Following completion, all warranties, guarantees, and related obligations continue for the applicable Guarantee Period. 

1.8 Compliance with Laws and Industry Standards 

Solar System Batteries Australia Pty Ltdr will comply with all applicable laws, including: 

  • Australian Consumer Law; 
  • Relevant electrical and safety regulations; and 
  • The Clean Energy Council (CEC) Solar Retailer Code of Conduct (where applicable). 

1.9 Definitions 

Capitalised terms used throughout this Agreement have the meanings provided in Clause 18. 

2. Sale of the System

Subject to satisfaction of Clause 1.5, Solar System Batteries Australia Pty Ltdr agrees to sell, and you agree to purchase, the System described in the Quote and Full System Design. 

3. Payment Terms

3.1 Currency 

All transactions under this Agreement are processed in Australian Dollars (AUD). 

3.2 Deposit 

A minimum Deposit of 10% is payable upon acceptance of the Quote unless otherwise stated. 

3.3 Balance Payment 

The remaining balance must be paid when installation is scheduled unless otherwise agreed in writing. 

3.4 Transfer of Title 

Ownership of the System transfers to you only after all outstanding amounts have been paid in full. 

3.5 Payment Methods 

Payments may be made by: 

  • Direct Deposit
  • Debit Card
  • Credit Card 
  • Cash
  • Bank Cheque 
  • Money Order 

3.6 Cleared Funds 

Payment is deemed received only once cleared funds have been received into our nominated bank account. 

4. Refunds & Cancellations

4.1 Refund Eligibility 

If this Agreement ends before installation for any of the following reasons, Solar System Batteries Australia Pty Ltd will refund all monies paid: 

  • Installation has not occurred within four (4) weeks of the original Target Date and you terminate the Agreement; 
  • You reject a notified price increase under Clause 6; 
  • Grid Connection Approval is refused; or 
  • Quoted equipment becomes unavailable and no mutually acceptable alternative can be agreed. 

4.2 Non-Refundable Costs 

Solar System Batteries Australia Pty Ltd reserves the right to deduct any reasonable administrative, design, permit, inspection, or application costs already incurred. 

5. State & Federal Battery Rebates

5.1 Rebate Estimates 

Quoted pricing may include estimated incentives or rebates under government programs including, but not limited to: 

  • NSW Smart Energy Program; 
  • WA Battery Incentive Scheme; and 
  • Federal Battery Rebate programs. 

5.2 Eligibility 

All rebates remain subject to government eligibility requirements and approval processes. Solar System Batteries Australia Pty Ltd does not guarantee rebate approval or payment. 

5.3 Customer Cooperation 

You agree to provide all information, documentation, and authorisations required to process rebate applications. 

5.4 Ineligibility or Rejection 

If a rebate application is unsuccessful, withdrawn, rejected, or deemed ineligible, you agree to repay the rebate amount deducted from the quoted system price. 

5.5 Withdrawal from Rebate Process 

If you choose not to proceed with the rebate process, the applicable rebate amount will be added back to your invoice. 

5.6 Government Changes
Solar System Batteries Australia Pty Ltd reserves the right to revise pricing if rebate programs, eligibility requirements, or rebate values change prior to installation. 

5.7 Limitation of Liability
Solar System Batteries Australia Pty Ltd is not liable for losses, delays, or costs arising from rebate processing delays, rejection, or government changes. 

6. Price Variations

6.1 Right to Adjust Pricing
Solar System Batteries Australia Pty Ltd may increase pricing to account for: 

  • Increased material costs; 
  • Freight increases; 
  • Regulatory changes; 
  • Additional installation requirements; or 
  • Other reasonable unforeseen costs. 

6.2 Conditions for Price Changes
Price adjustments will only occur where: 

  • The increase is reasonable; 
  • Permitted by law; and 
  • Written notice is provided at least seven (7) days before installation. 

6.3 Customer Rights
If you do not accept a notified price increase, you may terminate this Agreement before installation and receive applicable refunds under Clause 4. 

6.4 Deemed Acceptance
If no objection is received before installation, the revised price will be deemed accepted. 

7. Grid Connection & Approvals

7.1 Grid Connection Application
Solar System Batteries Australia Pty Ltd will apply for Grid Connection Approval on your behalf. 

7.2 Approval Outcome
This Agreement is conditional upon Grid Connection Approval being granted. 

7.3 Refusal of Approval
If approval is refused, this Agreement automatically terminates and applicable refunds will be issued. 

7.4 Other Approvals
You are responsible for obtaining any other approvals, permits, or consents required for installation at the Premises. 

8. Delivery & Installation

8.1 Delivery
Solar System Batteries Australia Pty Ltd will arrange delivery of the System to the Premises once all conditions have been satisfied. 

8.2 Risk Transfer
Risk of loss, theft, or damage transfers to you upon delivery to the Premises. 

8.3 Installation
Installation will be completed by a SAA-Accredited Installer in accordance with applicable Australian Standards and Clean Energy Council guidelines. 

8.4 Target Installation Date
Target installation dates are estimates only and may change due to weather, approvals, product availability, safety requirements, or other operational circumstances. 

8.5 Installation Delays
Solar System Batteries Australia Pty Ltd will notify you of any revised Target Date as soon as reasonably practicable. 

8.6 Delay Beyond Four Weeks
If installation has not occurred within four (6 – 8) weeks after the original Target Date, you may terminate this Agreement and receive applicable refunds. 

8.7 Electrical Safety Documentation
Following installation, Solar System Batteries Australia Pty Ltd will provide any legally required electrical compliance or safety certificates. 

8.8 Roof & Structural Conditions
Solar System Batteries Australia Pty Ltd takes reasonable care during installation but is not responsible for: 

  • Existing roof defects; 
  • Structural inadequacies; 
  • Roof warranty impacts; or 
  • Damage not caused by Solar System Batteries Australia Pty Ltd negligence. 
9. Access to Premises

9.1 Access Rights
You grant Solar System Batteries Australia Pty Ltd and its contractors permission to access the Premises for: 

  • Site inspections; 
  • Delivery; and 
  • Installation works. 

At least three (3) Business Days’ notice will be provided where practical. 

9.2 Customer Presence
You or your authorised representative must be present during inspections and installation. 

9.3 Site Requirements
You must ensure: 

  • Safe and unobstructed access; 
  • Compliance of electrical infrastructure; 
  • Roof suitability; and 
  • Adequate installation conditions. 
10. System Maintenance

10.1 Maintenance Documents
Solar System Batteries Australia Pty Ltd will provide maintenance documentation relating to the System. 

10.2 Customer Responsibility
You are responsible for maintaining the System in accordance with manufacturer guidelines and maintenance documentation. 

11. STCs & Performance Estimates

11.1 Site-Specific Performance Estimate
Performance estimates are prepared in accordance with Clean Energy Council guidelines. 

11.2 STC Incentive
The quoted STC Incentive is based on: 

  • Maximum eligible STCs; and 
  • Current market valuation. 

11.3 Assignment of STCs
You assign all rights, title, and interest in eligible STCs relating to the System to Solar System Batteries Australia Pty Ltd. 

11.4 Customer Cooperation
You agree to sign all required documentation and provide necessary information to facilitate STC creation and assignment. 

11.5 Customer Warranty 

You warrant that no prior STC rights have been assigned in relation to the Premises. 

11.6 STC Recovery 

If your actions reduce, invalidate, or prevent STC creation, Solar System Batteries Australia Pty Ltd may recover the STC Incentive amount from you. 

12. Warranty & Guarantees

12.1 Installation Warranty
Solar System Batteries Australia Pty Ltd provides a five (5) year workmanship warranty from the date of installation. 

12.2 Warranty Exclusions
The warranty does not apply where faults arise from: 

  • Misuse or neglect; 
  • Unauthorised modifications; 
  • Extreme weather events; 
  • Improper maintenance; or 
  • Third-party interference. 

12.3 Manufacturer Warranties
Manufacturer warranties remain separate and additional to Solar System Batteries Australia Pty Ltd workmanship warranty. 

12.4 Warranty Assistance
During the warranty period, Solar System Batteries Australia Pty Ltd will provide reasonable assistance with manufacturer’s warranty claims.

13. Complaints & Dispute Resolution

13.1 Complaints Process
Complaints may be submitted via:

13.2 Complaint Handling
Complaints will be managed in accordance with: 

  • Solar System Batteries Australia Pty Ltd internal procedures; 
  • Australian Consumer Law; and 
  • Applicable CEC complaint handling requirements. 

13.3 External Dispute Resolution
If unresolved, complaints may be referred to the relevant Fair Trading or Consumer Affairs authority in your State or Territory. 

14. Privacy

14.1 Privacy Compliance
Solar System Batteries Australia Pty Ltd complies with the Privacy Act 1988 (Cth) and all applicable privacy laws. 

14.2 Use of Information
Personal information may be used for: 

  • Installation and service delivery; 
  • Rebate applications; 
  • Grid connection applications; 
  • Warranty administration; and 
  • Customer support. 
15. Default & Termination

15.1 Customer Default
If you: 

  • Fail to make payment when due; or
  • Fail to provide required access or approvals, 

Solar System Batteries Australia Pty Ltd may suspend performance under this Agreement. 

15.2 Termination for Default
If the default is not remedied within seven (7) days of notice, Solar System Batteries Australia Pty Ltdr may terminate this Agreement. 

15.3 Recovery of Costs 

Upon termination due to customer default, you remain liable for all reasonable costs incurred by Solar System Batteries Australia Pty Ltd. 

16. GST

Unless otherwise stated, all pricing under this Agreement is inclusive of GST. 

17. General Terms

17.1 Notices
All notices must be provided in writing by post or email. 

17.2 Assignment
Neither party may assign this Agreement without written consent. 

17.3 Subcontracting
Solar System Batteries Australia Pty Ltd may subcontract work to qualified contractors, including CEC-Accredited Installers. 

17.4 Amendments
Any amendment to this Agreement must be written and signed by both parties. 

17.5 Waiver
Failure to enforce any provision does not waive future rights. 

17.6 Severability
If any provision is found unenforceable, the remaining provisions remain valid. 

17.7 Governing Law
This Agreement is governed by the laws of the State or Territory in which the Premises are located. 

18. Definitions

For the purposes of this Agreement: 

  • Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth). 
  • Balance means the remaining amount payable after the Deposit. 
  • Business Day means a day excluding weekends and public holidays. 
  • CEC-Accredited Installer means an installer accredited by the Clean Energy Council. 
  • Deposit means the amount specified in the Quote. 
  • Full System Design means the final system layout, specifications, and performance estimates. 
  • Grid Connection Approval means approval from the relevant electricity distributor. 
  • Premises means the installation address listed in the Quote. 
  • STC means Small-scale Technology Certificate. 
  • System means the solar PV system and associated equipment supplied under this Agreement. 
  • Target Date means the proposed installation date. 
  • Total Price means the total quoted amount payable. 
19. Additional Installation Conditions

19.1 Standard Installation Requirements 

Advertised pricing applies only to standard installations, including: 

  • Single-storey homes; 
  • Pitched tin roofs; 
  • Metro locations within 80km of Solar System Batteries Australia Pty Ltd offices; and 
  • Modern compliant switchboards. 

Additional charges may apply for: 

  • Tile roofs; 
  • Flat roofs; 
  • Double-storey or multi-storey buildings; 
  • Regional locations; 
  • Switchboard upgrades; or 
  • Non-standard installation conditions. 

19.2 Meter Box Requirements 

Meter boxes must comply with current Australian Standards including: 

  • Fire-resistant backing board; 
  • Metal enclosure; 
  • Circuit breakers installed; 
  • No exposed or loose wiring; and 
  • Sufficient isolation switch space. 

19.3 Property Conditions 

The property must: 

  • Be fully constructed; 
  • Have compliant wiring and power supply; 
  • Provide safe vehicle access; and 
  • Include a suitable inverter location. 
20. 30-Day Price Guarantee

20.1 Eligibility
Solar System Batteries Australia Pty Ltdr may beat a comparable written competitor quote by 10% subject to: 

  • Comparable specifications; 
  • Competitor stock availability;
  • Metro installation areas; 
  • Formal written quotation evidence; and 
  • One claim per property. 

20.2 Exclusions
The guarantee excludes: 

  • Liquidation sales; 
  • Commercial quantities; 
  • Wholesale pricing; 
  • Trade pricing; and 
  • Non-stocked products. 

20.3 Claim Requirements
Claims must be submitted before installation and within 30 days of the competitor quotation. 

21. Referral Bonus Program

21.1 Eligibility
Referral bonuses apply when: 

  • The referred customer signs a contract;
  • Installation is completed;
  • Full payment is received; and
  • The referral was registered before installation. 

21.2 Referral Bonus Amounts 

Potential referral bonuses include:

19.8kW  Up to $450 
Above 25kW  Up to $600 

21.3 Payment Timing 

Referral payments will be issued within 30 days of successful installation and final payment. 

21.4 Exclusions 

Self-referrals and immediate family members at the same address are excluded. 

21.5 Program Changes 

Solar System Batteries Australia Pty Ltdr reserves the right to modify, suspend, or cancel the referral program at any time. 

22. AI Communications

By engaging with Solar System Batteries Australia Pty Ltd, you consent to receive communications via: 

  • Phone calls; 
  • SMS messages; and
  • Email communications, 

including communications generated or assisted by AI-powered virtual assistants. 

These communications may include: 

  • Appointment confirmations; 
  • Service reminders; 
  • Support follow-ups; and 
  • Promotional offers. 

You may opt out at any time by following the instructions in the communication or by contacting Solar System Batteries Australia Pty Ltd directly. 

Acceptance

By accepting the Quote, paying the Deposit, or instructing Solar System Batteries Australia Pty Ltd to proceed, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
